Call of the Day: Non-Disclosure Agreement

We have a non-disclosure agreement as part of our handbook, do we really need an employee to sign a second agreement if they sign that they have received the handbook?


You employee handbook can reference agreements but the actual documents must stand outside of your handbook in order for it to stand up in court.  So, be sure to flag all contracts and agreements that have been inserted into your handbook.  They can be things such as arbitration agreements, nondisclosure agreements or other policies in which you require the employee to enter into an agreement.  An acknowledgement form is not sufficient to turn agreements or policies into enforceable contracts.
